Pub or bar accident claims can help you recover compensation if you were injured due to someone else’s failure to ensure your safety whilst at a pub or bar.

Legally, pubs and bars owe their patrons a responsibility to ensure their reasonable safety. This can include maintaining a safe environment, including regular maintenance of stairs, exits and floors, whilst also making sure that their staff are adequately trained and that there is appropriate security implementation.

At Advice, our solicitors understand that pub or bar accidents can lead to an array of injuries, including lifelong head injuries, or less serious injuries such as simple fractures of the forearm. Not just this, but these accidents can lead to psychological injuries and financial losses, particularly where you have had to take time off during your recovery. At such a difficult time, you may worry about the future and how to move forward.

This is where our solicitors will aid you; with specialist training and experience, we can help you seek the compensation you deserve in pub or bar accident claims. By connecting you with recovery experts, we’re fully committed to ensuring that your compensation not only covers your immediate losses but also provides the financial stability to fund any ongoing care you may now require.

Can I Claim For Accidents In A Pub Or Bar?

Yes, you could claim for accidents in a pub or bar if we can show that the pub owner or operator failed to take appropriate steps to ensure your reasonable safety. At Advice, our experienced public liability solicitors have extensive experience handling pub and bar accident claims and understand the types of evidence that may help establish liability and support a claim for compensation. They will make sure that you have a strong case that proves the following criteria:

You Were Owed a Duty of Care

For pub or bar accidents, under the Occupiers’ Liability Act 1957, you are owed a legal obligation from pub or bar owners to ensure your reasonable safety. This extends to visitors, staff members and any customers within their premises.

Per this duty of care, the owners of pubs and bars must make sure that the environment is maintained and safe for purpose, promptly address any risks such as defective or wet floors, and identify any risks that may cause injury to visitors.

This Duty of Care Was Breached

We must then determine that the pub owner or bar owner breached their duty of care. This can arise if they fail to manage overcrowding, provide their staff with inadequate training or if the premises are poorly maintained.

Additionally, if spillages aren’t signposted or cleaned up promptly, this could also constitute a breach.

You Suffered Injuries As a Result

Finally, to be eligible to seek compensation in pub or bar accident claims, we must show a direct link between the breach of duty and your injuries. No matter whether you have suffered a minor or serious injury, or even psychological injury, you could recover compensation for this, provided that it is medically recognised. If your claim is valid, you’d also have grounds to seek compensation for multiple injuries.

To find out in minutes whether you could make a pub or bar compensation claim with our expert solicitors here at Advice, get in touch with our advisory team today. They can provide you with an obligation free consultation, and explore the options available to you.

Pub Or Bar Accident Claims Examples

Pub or bar accidents can happen in many different ways, such as injuries caused by slips, trips and falls due to uncleaned drink spillages, faulty furniture or even tripping over broken or defective flooring.

Some more examples of pub or bar accidents could include:

  • A patron had spilled a drink across a concrete floor in a bar. The bar staff failed to provide signage, or clean the spillage up adequately. You slipped on this spillage, causing a broken wrist and leg as a result.
  • Broken glass bottles that weren’t cleared away from the bar area cause you to cut your arm quite seriously, leading to permanent scarring.
  • Due to a lack of security and overcrowding in a local pub, you suffer a crushing injury to your legs when you are trampled by multiple people.
  • A pub failed to repair defective seating, despite being made aware of the defects multiple times. As a result, you suffer a back injury when a bar stool collapses.

These examples aren’t exhaustive, so to discuss how your accident occurred, please get in touch with our solicitors today. They’re available to listen, offer support, advise on how to claim and assess whether you would be eligible to recover compensation in pub or bar accident claims.

What Injuries Might Be Sustained In A Bar Or Pub?

Injuries sustained in a bar or pub accident can range from minor injuries such as bruising or lacerations, to severe life-altering injuries such as head injuries or permanent back injuries.

Some other injuries that can be sustained after an accident in a bar or pub can include:

These aren’t the only injuries that can be sustained in a pub or bar accident, so to discuss your own experience, please don’t hesitate to get in touch with our advisory team today.

How Much Pub Accident Compensation Can I Claim?

The amount of pub accident compensation that you could claim will depend on the type of injuries you sustained, the severity of your injuries, as well as the impact that these injuries may have had on your daily life. For example, if your mobility has been permanently affected, this will be taken into account when our solicitors value your compensation.

In addition to these considerations, compensation can be made up of two different heads of loss, called general damages and special damages. The first head of loss aims to compensate you for the physical and psychological injuries caused by your accident.

When general damages are being calculated, those responsible can consider the extent of physical pain, suffering and any impact to your quality of life. Our solicitors will consider documents such as the Judicial College Guidelines (JCG) which offers categories of injury types, differing severities and guideline brackets of compensation when assigning value to your pain and suffering.

We’ve provided a list of some of these figures below, however please be aware that the top entry has not been taken from the JCG, and these figures are suggestive only, and not a guarantee of compensation.

Compensation In Pub Or Bar Accident Claims

  • Multiple Very Severe Injuries + Special Damages: up to £1,000,000+. This may be awarded for cases where a number of very severe injuries have been sustained, and for financial losses such as lost income, medical expenses or professional care costs.
  • Brain Damage Very Severe: £372,570 to £533,720. Maybe some limited ability to follow basic commands, but little if any remaining response to their environment.
  • Back Injuries Severe (a)(i): £120,340 to £212,670. The most severe back injuries including damage to the nerve root endings and spinal cord.
  • Back Injuries Severe (iii): £51,230 to £92,130. Disc lesions or fractures of the discs in vertebral bodies, or soft tissue injuries leading to chronic conditions.
  • Pelvis and Hip Injuries Severe (i): £103,580 to £172,970. Extensive pelvis fractures causing intolerable pain necessitating spinal fusion.
  • Leg Injuries Severe (ii) Very Serious: £72,440 to £117,210. Injuries causing permanent mobility problems, usually where multiple fractures have taken years to heal.

Can Pub Or Bar Accident Claims Cover Special Damages?

Yes, compensation in pub or bar accident claims can also cover special damages. This head of loss aims to reimburse you for the financial losses incurred as a result of your injuries.

Advice could help you recover special damages compensation for things such as:

  • Loss of earnings, for any time you’ve taken out of work during your recovery period
  • Medical expenses including ongoing prescriptions, private medical treatments or any associated costs of reconstructive surgeries
  • Costs of care, whether this includes professional round-the-clock assistance, domestic support or gratuitous care from friends and family
  • Travel expenses such as fuel costs to and from appointments, or taxis
  • Replacement or repair costs for damaged personal items, such as clothing stained by spillages that caused the accident, or glasses and mobile phones damaged during a fall

You could also be compensated for any other provable financial losses caused by your injuries. However, in order to claim special damages, you will need evidence of these financial losses.

This could usually include payslips that show lost earnings, invoices for any expenses and receipts, all of which our solicitors could help you to obtain to strengthen your potential pub or bar compensation claim. Call an advisor to discuss what special damages may apply in your specific circumstances. The advisory team can also estimate how much compensation your pub or bar accident claim could be worth.

What If I Was Attacked At A Pub Or Bar?

If you were attacked at a pub or bar, you could be eligible to claim through the Criminal Injuries Compensation Authority (CICA). This is a government scheme set up to compensate those injured by violence. At Advice, our solicitors can help make a criminal injury claim and ensure that all the paperwork for it is correctly filed.

In order for you to be able to claim through the CICA, it will need to be shown that:

  • The violent crime took place in Great Britain, or in a vessel registered here
  • You were injured in a crime of violence, defined within the CICA such as an assault
  • This violent crime was reported to the police
  • Your claim is brought within the time limits, which is typically 2 years for a CICA claim

Our specialist solicitors have years of experience helping claimants make their own CICA claim, so if you have any questions, please don’t hesitate to get in touch with our advisory team today.

Who Would Be Responsible For Pub Or Bar Violence?

Depending on the circumstances of the violent crime, the perpetrator themselves or the pub or bar could be responsible.

Any pub or bar owes a duty of care to their patrons to ensure their reasonable safety, which can also extend to making sure that there is enough security present to prevent violent crimes. If they fail to do so, and this leads to you suffering an assault, they may be deemed vicariously liable for your injuries.

To learn more about who might be responsible for your injuries, please contact us today.

How Much Compensation Can I Get For A Bar Or Pub Assault?

The amount of compensation you could receive for a pub or bar assault claim will depend, again, on the injuries sustained. However, any injuries you are claiming for will be valued in accordance with the tariffs found within the Criminal Injuries Compensation Scheme 2012. These are fixed amounts, meaning that if your claim is successful then you would receive the exact amount listed that relates to your injuries.

Additionally, if you’re claiming for more than one injury, then your claim would be subject to the multiple injuries formula. This means that:

  • You would receive 100% of the tariff amount for your injury of the highest value
  • You’d receive 30% of the tariff amount for the second-highest valued injury
  • You would receive 15% of the tariff for your third-highest valued injury

What Will I Need To Bring A Bar Or Pub Injury Claim?

In order to bring pub or bar accident claims, you will need evidence that proves how someone else’s actions or inactions caused your injuries. As well as this, you’ll have to ensure that your claim is started within the time limits, however, there are a few steps that you can take to protect your health and wellbeing, whilst also strengthening your potential claim.

Below, we’ve created a streamlined list of these steps, to help you understand what steps to take. If you decide to work with Advice on your claim, our solicitors will manage a lot of these steps for you, so you can concentrate on recovery.

Seek Medical Help

After a pub or bar accident, the first thing you should do is seek urgent medical attention. Your main priority after any incident is your physical and mental wellbeing, so seeking urgent medical help prevents your symptoms or injuries from worsening, and also means that a medical professional can fully assess the extent of your injuries.

Additionally, visiting a medical professional means that an official medical record is produced, and can show any treatments or diagnoses you received after the accident. Making sure to follow appropriate medical advice, and attending any treatments or appointments can help to show that you took your recovery seriously. As part of the claims process, our solicitors will request a copy of your medical records.

Gather Information About The Accident

Once you have received adequate medical assistance, you should try to record details about the accident. The earlier that evidence is gathered, the easier it is to preserve the documents and often can mean that the information is more reliable in your case.

The type of evidence needed for pub or bar accident claims can include:

  • CCTV footage of the accident
  • Photographs of the accident scene, any hazards or visible injuries
  • Comprehensive medical records detailing any treatments, medications or upcoming appointments
  • Contact details of any potential witnesses so that we can later gather a statement about your pub or bar accident

One of our specialist solicitors could help you with gathering these documents to build an unshakeable body of evidence to support your claim. Contact Advice today to speak to a solicitor about gathering evidence.

Make an Official Record of The Incident

After an accident in a pub or a bar,  you should immediately report the accident to the staff or management of the venue, and depending on the circumstances of the accident, you could also report the accident to your local police force. Although you shouldn’t worry if you haven’t done this, as one of our solicitors can help you make this report.

This official record can be used as valuable evidence in your claim, as it can be used to confirm how, where and when the accident occurred.

Keep Ongoing Notes About Your Injuries

Your injuries might initially seem minor, but keeping an ongoing record of how the accident and injuries continue to impact you can be really useful. Make sure to keep notes of:

  • Daily pain levels and symptoms
  • Any sleep disruption
  • Problems with your mobility
  • Emotional impacts

We would also suggest keeping copies of any receipts and records for any financial losses incurred following your injuries. This could include costs for medication, travel expenses for any appointments, costs related to medical treatments and any time taken off work during your recovery.

These documents can be used to help value your compensation and ensure that it reflects the financial losses caused by your injuries.

Speak to a Personal Injury Solicitor

Getting in touch with a specialist pub or bar accident solicitor at Advice can help provide clarity about the options available to you. They’re able to assess whether you would have an eligible claim, and explain how the process works in practice.

Additionally, a solicitor can offer advice on how strong your evidence is, and provide estimates on the value of your claim. Early advice can also prevent any mistakes that could weaken your case at a later stage.

Make Sure Your Claim Is Within the Time Limits

Generally, personal injury claims are subject to time limits, established within the Limitation Act 1980. Per this, you will usually have 3 years from the date of the pub or bar accident to start your claim. It’s important that your claim is started within this period, to prevent it from becoming time-barred. However, if an injured party cannot manage their own claim, then this time limit is paused or suspended altogether.
