Expenses Your Criminal Injuries Compensation Can Include

The CICA can also awarded compensation for your ‘special expenses’. These are necessary, but reasonable, expenses, needed as a direct result of your stab injury that cannot be acquired for free elsewhere. Examples include:

  • Property or equipment relied on as a physical aid that was lost or damaged in the stabbing.
  • Costs related to medical care arising from treatment for your injury under the NHS, or where these costs would have arisen had you been treated through the NHS.
  • Special equipment, such as adapted vehicles, kitchen implements or a wheelchair.
  • Adaption of your accommodation including changes inside and outside of your home to improve your independence.
  • Costs connected to care related to bodily functions or meal preparation.
  • Supervision costs to avoid substantial danger to yourself or another person.
  • Fees to the Court of Protection or Public Guardian.
  • Administration of affairs costs.

Loss of wages or salary (in CICA claims, you have to be absent from work for more than 28 weeks, and you will only receive pay at the statutory sick pay rate) can also be awarded.

One of our advisors can further explain special expenses to you as well as estimate how much compensation you could be awarded.

My Attacker Escaped – Can I Get Compensation?

When making a claim through the CICA for getting stabbed, you may wonder, ‘Can I get compensation even if my attacker escaped?’

If you have been injured in a crime of violence, as defined by the CICA, you can still make a claim even if your attacker escapes. However, you will need to ensure that you meet the relevant criteria and can provide sufficient evidence before pursuing a claim through the CICA. The criteria include:

  • The claim must be made within the relevant time limits (see the next section).
  • The incident must have taken place in Scotland, England, Wales or other relevant place (such as a ship registered to one of these countries).
  • You will need to provide a police reference number to prove that the crime was reported.
  • You will need evidence that you meet the residency requirements.
  • Medical evidence regarding your stab wounds and the treatments you needed to receive for them.

The CICA will be able to contact the police for further information relating to the incident.

Our criminal injuries compensation calculator may be able to help you gain a clearer idea of how much compensation you could be owed. It will do this by asking you a variety of questions about how you were injured and the injuries you sustained.

Do not hesitate to contact one of our advisors today if you have any further questions about starting a criminal injury claim.

What Is The Process To Claiming Compensation For A Stabbing Injury?

The process to claiming compensation for a stabbing injury often involves taking steps to protect your health, evidence, and legal position. We understand that seeking justice for a stabbing injury is a courageous step, and our solicitors can help lift this burden by helping you with evidence.

As such, you could take the following practical steps to strengthen your position:

  • Prioritise Your Wellbeing – Following a stabbing injury, you should seek immediate medical attention from a hospital or an urgent care clinic. You should also seek help for complications caused by the stabbing, as well as any psychological effects. Not only can this hugely aid your recovery, but it can also create official medical records of the incident.
  • Secure The Official Record – When making a claim through CICA, it’s required that the incident has been reported to the police. If you’re connected with our expert solicitors, they could help to obtain your police report on your behalf, where appropriate.
  • Compile Evidence – Our solicitors can help you to identify and gather supporting evidence about the incident and your injuries if the CICA ask for further information. Helpful evidence can include CCTV of the stabbing, witness contact details, and photographs of your injuries.
  • Record The Long-Term Impact – Stabbing injuries can be long-lasting, often encompassing both physical and mental effects. You should start to keep a daily symptoms diary, detailing your pain levels, treatments, medications, and the overall effect on your life and relationships. You should also record the financial losses you suffered.
  • Navigate The Time Limits – You will generally have up to 2 years from the stabbing incident to start your criminal injury claim. However, certain exceptions may exist if something prevented you from reporting the incident to the police.
