I Had An Accident In Asda, How Much Can I Claim?

When you make a successful supermarket accident claim, the settlement that you receive can consist of a number of different types of damages, general damages and special damages. Special damages could potentially be included if you’re eligible to claim general damages.

General damages compensate for any loss of amenity, psychological suffering or physical pain inflicted by the injury. You can see example awards for general damages in the section above. The amount you receive will depend on the severity of factors such as:

  • Loss of life quality
  • Permanent disability
  • Psychological damage
  • Mental anguish, trauma and stress
  • Pain and suffering

We’ve put together the table below, which is based on information sourced from the Judicial College Guidelines. This text pairs these brackets with various injuries and illnesses. The table is purely included for guidance, and the first row isn’t from the document.

Injury Type And SeverityNotesCompensation
Multiple Serious Injuries And Special DamagesSpecial damages might include a loss of earnings.Up to £500,000+
Brain Injury - Moderately SevereThe injured person will be very seriously disabled. There may be physical disabilities alongside impairment of intellect and personality.£267,340 to £344,150
Brain Injury - Moderate (i)Moderate to severe intellectual deficit. Other effects of the injury may include a personality change and significant risk of epilepsy.£183,190 to £267,340
Arm Injury - Severe InjuriesInjuries that are so serious they leave the person little better off than if the arm had been lost.£117,360 to £159,770
Arm Injury - Less Severe InjurySignificant disabilities, but substantial recovery will have taken place or will take place in the future.£23,430 to £47,810
Leg Injury - Severe (iii) SeriousSerious fractures or damage to joints or ligaments. There will be a lengthy period of non-weight bearing, extensive scarring and near certainty that arthritis will ensue.£47,840 to £66,920
Leg Injury - Severe (iv) ModerateComplex or multiple fractures or major crush injuries to one leg.£33,880 to £47,840
Shoulder Injury - SevereSignificant disability likely to occur. May involve damage to the brachial plexus.£23,430 to £58,610
Shoulder Injury - SeriousThis bracket could apply to various injuries such as a serious dislocation, soft tissue damage or a rotator cuff injury.£15,580 to £23,430
Hand Injury - ModerateMay include deep lacerations, soft tissue injuries or crush injuries.£6,910 to £16,200

The purpose of special damages is to ensure you are in the same financial position as you were before you suffered the injury in question. When seeking to recover such expenses, it’s important to retain all receipts, bills and paperwork. Without evidence, you may not be able to claim them back. Examples of what you can recover include:

  • Reduced ability to work
  • Loss of wages or salary
  • Cost of hiring a nurse or home help
  • Medical charges
  • Travel fees

What Is Asda’s Duty Of Care To Customers, Staff And Other People On Its Property?

In order for you to be able to make a supermarket injury compensation claim, the supermarket must be liable for the harm that you have suffered. There are multiple levels of legislation that a supermarket has to comply with, which are intended to keep both members of the public and employees safe.

Firstly, in respect of employees, employers must comply with the legal duties set out in the Health and Safety at Work etc. Act 1974. Secondly, there is the Occupiers’ Liability Act 1957. The supermarket must comply with these regulations at all times. It ensures that they monitor health and safety risks by conducting regular inspections, risk assessments and repairs or replacements when necessary. This all ensures that the workplace is safe and free from the risk of harm.

Common Asda Supermarket Accidents

There are many reasons why a person may be eligible to make a supermarket compensation claim. However, some kinds of accidents, injuries and illnesses are more common than others, and these can include:

  • Slips, trips or falls.
  • Food poisoning and food-related allergic reactions.
  • Accidents caused by damaged fixtures and fittings in the supermarket.
  • Injuries caused by shopping trolleys.
  • Spilt food causing a slip hazard.
  • Falling objects causing an injury.

We can help you claim for almost any kind of incident, but these could be construed as the most common. We will cover each of these in its own section below.

How Long Do Supermarket Accident Claims Take And Is There A Time Limit?

There is a 3-year personal injury claims time limit in place, within which you are going to need to start your claim. This typically begins from the date of the accident.

To find out if a different time limit applies in your own case, due to special circumstances, please speak to one of our claims team on the number below.

No Win No Fee Accident In Asda Compensation Claims

If you had an accident in Asda because a third party breached their duty of care, and this caused you injury, you could potentially have valid grounds to claim personal injury compensation. After assessing your case, our team of advisors could connect you with one of our No Win No Fee solicitors. They can support a valid personal injury claim following an accident under what’s called a Conditional Fee Agreement (CFA).

Claiming for a supermarket accident under a CFA means you won’t need to pay your solicitor for their services before your claim has begun or while it’s being processed. You also don’t need to pay your solicitor for their work if the claim fails.

If your supermarket injury claim wins, a success fee will be deducted from your compensation. There is a legal cap that limits the percentage your solicitor can subtract to cover their fee. This cap ensures that you will keep most of the compensation.
