Who Can Make A Claim For Soft Tissue Damage In The UK?
In order to have valid grounds to make a soft tissue injury claim, you must meet the personal injury claims criteria. This means that you must prove that:
- You were owed a duty of care.
- This duty was breached.
- You suffered an injury because of this breach.
There are various daily situations where you could suffer a soft tissue injury. These include:
- A road traffic accident. Every road user owes one another a duty of care to use the roads in a way that prevents either themselves and others becoming injured. To uphold this duty, they must adhere to the Road Traffic Act 1988 and any relevant rules and regulations found in the Highway Code.
- An accident at work. Employers owe their employees a duty of care. This is set out in the Health and Safety at Work etc. Act 1974 (HASAWA), which stipulates that your employer must use practicable steps to protect the health and safety of their employees while working.
- A public liability accident. While in a public place, the controller of the space owes you a duty of care. This is set out under the Occupiers’ Liability Act 1957, which states that they must take practical action to ensure visitors are reasonably safe.

Average Compensation For A Soft Tissue Injury In The UK
You might be wondering what the average compensation award for a soft tissue injury claim is. However, it can be hard to pinpoint an average amount. This is because every personal injury claim is different, and each compensation award depends on the unique circumstances of each case.
Generally, soft tissue injury compensation can be made up of two headings: General damages and special damages.
All successful claimants will receive general damages. Under this heading, you can claim compensation for the physical and psychological effects you are suffering due to the soft tissue injuries. As such, here are some factors that are taken into consideration:
- The severity of your pain.
- The predicted length of recovery.
- Loss of amenity.
The Judicial College Guidelines (JCG) can help calculate this head of claim. This document lists a number of different injuries, including soft tissue damage, in addition to guideline compensation brackets.
Guideline Compensation
Below, you can find some of the JCG’s brackets. Please note that these are not a guarantee of compensation for your soft tissue injury claim, and that the first figure is not taken from the JCG:
- For multiple severe injuries, plus special damages, up to £500,000+ could be awarded. Special damages might be for lost income, physiotherapy costs, and private medical treatment.
- For a severe (iii) back injury, where soft tissue damage leads to chronic conditions that remain despite treatment, between £47,320 to £85,100 could potentially be awarded.
- For a moderate (ii) back injury, where soft tissue damage leads to the exacerbation of an already existing back condition (usually by 5+ years), between £15,260 to £33,880 could potentially be awarded.
- For a very severe ankle injury, where extensive soft tissue damage leads to deformity, between £61,090 to £85,070 could potentially be awarded.
- For a severe (iii) neck injury, where severe soft tissue damage leads to chronic conditions and permanent, significant disability, between £55,500 to £68,330 could potentially be awarded.
- For a moderate (ii) neck injury, where soft tissue damage leads to cervical spondylosis, between £16,770 to £30,500 could potentially be awarded.
- For a less serious (i) leg injury, where soft tissue damage causes a significant cosmetic deficit and/or some lower-limb nerve damage, between £21,920 to £33,880 could potentially be awarded.
- For a soft tissue injury to the wrist (d), where it takes longer than 12 months for a complete recovery to be made, between £7,420 to £12,630 could potentially be awarded.
Special Damages
Some successful claimants will also receive special damages. Under this heading, you can claim compensation for the financial losses you have incurred due to the soft tissue injuries.
Types of financial losses or expenses you could endure include:
- Loss of earnings if you needed time off work. For example, you may have needed surgical repair for damage to your soft tissues and needed time to recover.
- Medical bills, such as physical therapy costs.
- Domestic help bills, such as a cleaner while you recover from your injuries.
Since not all successful claimants receive special damages, having evidence of your financial losses is essential. Such evidence includes payslips, receipts, bank statements, and invoices.

Soft Tissue Injury Claim – Time Limits
It’s important to make sure that your claim for soft tissue damage falls within the relevant time limit. For personal injury claims, you will typically have 3 years to start a claim, starting on the date that you suffer your injuries. This is outlined in the Limitation Act 1980, a piece of legislation which also outlines the exceptions that apply to this rule.
For example, the time limit is paused if the claimant was younger than 18 when they were injured. A litigation friend can pursue compensation for them while it is frozen. If no claim is started, then the time limit is reinstated on the day they turn and runs until the point at which they turn 21.
Similarly, the time limit does not apply to those who lack the mental capacity to make their own claim. As with minors, a litigation friend can claim on their behalf, but if they do not, the time limit will only begin if they regain their capacity.
