How Much Can You Claim Through The Motor Insurers’ Bureau?

In order to answer the question, “How much can you claim through the Motor Insurers’ Bureau?” we need to first explain how personal injury compensation is calculated. There are two relevant heads of loss that compensation may be awarded under, these are:

  • General damages, which awards for physical and psychiatric injury.
  • Special damages, which awards for financial losses.

Those tasked with determining a potential compensation figure for your claim can refer to the medical evidence you provide alongside the Judicial College Guidelines (JCG). This publication contains guideline compensation brackets for various injuries, some of which have been provided below. We have also included figures from the Whiplash Injury Regulations 2021 fixed tariff at the bottom of the table.

Compensation Amounts

It is important we emphasise that the JCG entries are to be used as guidance only. The first bullet point is not a JCG figure.

  • Multiple very severe injuries with additional special damages such as care costs, rehabilitation and medical expenses – up to £1,000,000 and above.
  • Brain Damage – Moderately Severe – Very serious disability, with recurring constant care – £289,420 to £372,570.

When Could I Make A Claim Through The Motor Insurers’ Bureau (MIB)?

You will be eligible to make a claim through the MIB if you were hit by a driver who was either uninsured or untraced. To make your claim, you will need evidence to establish that:

  • You were injured in a road traffic accident
  • A driver breached their duty of care that they owed to you by ignoring the practical measures expected of them to ensure your safety.
  • This driver was either uninsured or untraced.

Evidence can include medical records to prove that you were injured, dashcam footage to prove the breach and a note of their registration plate, which you reported to the police to prove that they were uninsured.

Can I Claim Through The MIB If Hit By An Uninsured Driver

Yes, you can claim through the MIB if hit by an uninsured driver. The MIB aim to compensate people who have been injured in a road traffic accident but can’t directly claim from the responsible party. This includes those who have no insurance to cover the compensation.

Can I Claim Through The MIB If Involved In A Hit And Run

Yes, you can claim through the MIB if involved in a hit and run and the driver is not identified. They will be considered untraced, but you still deserve compensation to help with the recovery of your injuries and to reimburse you for the financial losses that you have suffered. Claiming through the MIB after being hit by an untraced driver will help you to gain the compensation that you deserve.

What If The Car That Hit Me Was Stolen – Can I Claim Through The MIB?

Yes, you can still claim through the MIB if hit by a car that was stolen, as the driver will not be insured on that vehicle. This also means that they may go untraced. To still gain compensation for the injuries caused by the negligent driver of the stolen vehicle, you can make your claim through the MIB.

Top Tips on Claiming MIB Compensation

MIB claims require evidence to be successful. Your evidence will need to establish that you were injured because of a road traffic accident and the incident was caused by another party that breached the duty of care they owed you.

There are numerous types of evidence you may be able to collect, including:

  • Medical reports that confirm your injuries and the treatment you’ve received for them.
  • Any video footage available of your accident, such as dashcam footage or CCTV footage.
  • Photographic evidence of the accident scene and the injuries you’ve suffered.
  • The contact details of any witnesses who can provide a statement about your accident.

What Is The Time Limit For MIB Claims?

According to the Limitation Act 1980, the time limit for claiming hit and run compensation is three years. This time limit begins from the date your incident occurred and also applies to claims made through the Motor Insurers’ Bureau.

In some circumstances, the time limit can be different. If the injured party is a child, then the time limit does not start for them until the day of their 18th birthday. Before that day, a claim could potentially be started on the child’s behalf by a litigation friend.

If the injured party lacks the mental capacity to claim on their own behalf, then the three-year time limit is suspended unless they become capable of claiming themselves. In such cases, a litigation friend may be able to represent the injured individual.

Don’t hesitate to contact our friendly team of advisors to learn more about the legal time limits in place. They can also provide you with MIB payout examples to give you a better idea of how compensation is calculated in such cases.

How Long Does It Take To Claim Through MIB?

MIB try to take three months or less to determine whether you should receive compensation. In some cases, they can reach a decision within 6 weeks.

However, you must consider that all claims are different and there is no guaranteed time frame for when you will receive compensation. Many aspects could impact how long your claim takes, such as:

  • Whether liability for the accident is disputed
  • How long the police take to provide a copy of the police report
  • Conflicting or insubstantial evidence
  • Whether an independent medical report is necessary
  • Whether medical experts can reach an agreement regarding the effects of your injuries (this can particularly apply to assessing the future impact of your injuries)
  • The valuation of special damages, such as the potential loss of future income

Sometimes, claimants struggle financially due to their injury and can’t wait for a compensation award. In such cases, you could be eligible for an interim payment. This is a payment that is made to you before the claim has settled.

There are set criteria for claiming an interim payment, so we welcome you to contact our advisors if you would like to discuss the matter further. They can also answer any general queries you can think of, such as ‘how much can you claim through the Motor Insurer’s Bureau?’. Additionally, they can use a compensation calculator to provide some MIB payout examples based on specific factors relating to your claim.
