What Does “No Win No Fee” Mean?
A No Win No Fee agreement is a way to fund the services of a personal injury lawyer or solicitor. Your personal injury solicitor may provide their No Win No Fee service under a Conditional Fee Agreement (CFA).
The purpose of this type of funding method is to allow a person to make a claim with a solicitor’s help without the (potential) financial pressure of having to pay for their services in advance.
The benefits of claiming through a No Win No Fee agreement include;
- There are no upfront solicitors fees or costs to pay to start the claims process.
- There are no ongoing solicitors fees to be paid during the claims process.
- Not having to pay legal costs for the solicitor’s work if the claim is not successful.
Under a No Win No Fee agreement, if your claim is successful, you will need to pay a success fee. Your solicitor will deduct this from the compensation that has been awarded to you. We will discuss this further in the next section.

What Is A Success Fee?
If your compensation claim made with the help of a solicitor working under a Conditional Fee Agreement is successful, they may be able to recover some of the legal costs associated with your claim from the defendant. There may however, still be legal costs and legal fees due.
Set out in the CFA will be a success fee. This is a set percentage of your compensation which is deducted by the solicitor to cover their costs. The success fee reflects the fact that claims may not be successful.
The maximum percentage that solicitors can charge is a 25% success fee. This percentage is legally capped at this amount, ensuring that claimants will always retain the bulk of their settlement. In addition to the success fee, other deductions may be made from the compensation award.
Any deductions and the percentage which will be charged will be fully explained to you prior to you signing the Conditional Fee Arrangement and starting the claims process.

Are There Other Costs In A No Win No Fee Claim?
After The Event (ATE) insurance is an insurance policy taken out to pay your No Win No Fee solicitor’s legal fees in the event that your claim is not successful. At the start of the claims process, your solicitor will thoroughly assess your case and the likelihood that it will be successful.
You may not need After the Event insurance if you already have Before the Event Insurance, which may be included as part of your Home Insurance policy. Your solicitor will advise you on this.

Who Pays My Solicitor If My No Win No Fee Claim Is Unsuccessful?
If you make an unsuccessful No Win No Fee claim, you will not be required to make any payments towards your solicitor’s work on your case.
A solicitor may recommend that you take out an ATE insurance policy. This is to make sure that they are paid for their work no matter the outcome of the case. Without doing so, the solicitor may be left out of pocket. Or, you may be left having to meet potentially large legal bills.
If you have any questions about how ATE insurance works and why a solicitor may advise you to take out such a policy, please contact our team.
Will My Personal Injury Compensation Be Taxed?
Before starting a claim under a No Win No Fee agreement, you may be concerned about any tax implications. Straight away, we should note that you do not pay any tax on compensation awarded for a personal injury. Interim payments made from your final settlement are also not taxable.
Claimants will also not need to pay tax on any interest earned on their settlement between the beginning of the claim and its settlement. However, if any interest accumulates between this settlement date and the date you physically receive your compensation, you will need to declare this on a tax return. There could be tax on this sum.
Additionally, if you invest money awarded in a compensation claim, you may be charged tax on interest.
Your personal injury solicitor may be able to provide more information on when compensation is taxable. You can also consult your bank manager or other financial advisor for more information.

How Long Could My Personal Injury Claim Take?
How long your No Win No Fee claim may take will depend on the individual circumstances of your claim. Factors such as,
- The type of injury sustained,
- The severity of injury,
- Whether the defendant accepts, disputes or denies their liability for the accident,
In general, the more complex a case, the longer it could take to settle. For example, a complex level of harm caused by medical negligence could take longer to resolve than a simpler slip or fall claim. However, this is not always the case.
Additionally, you should be aware that there is a time limit on personal injury claims. For more information on how long after a road accident, accident at work or other type of accident you could claim, please contact us.
